Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Phill - Pill Reminder ("Phill," "the App," "the Service"), you ("User," "you," "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not install or use the App. These Terms constitute a legally binding agreement between you and MintSoft ("we," "us," "our," "MintSoft"), an independent software studio operating under the laws of the Republic of Korea. By using the App, you represent that you are at least 13 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Service

Phill is a personal medication management application designed to help individuals track their prescription and non-prescription medications. The App provides the following core functionality:

Create and manage detailed medication profiles including name, dosage, schedule, and frequency
Receive local push notification reminders for scheduled doses and refills
Record and review medication intake history
View a calendar display of past and upcoming doses
Generate monthly PDF adherence reports
Display a home screen widget for at-a-glance medication status
Optionally sync reminder events to your device's calendar
Access text-to-speech readout of medication information

MintSoft does not verify the accuracy of any medication information you enter. Always follow the instructions of your physician, pharmacist, or other licensed healthcare provider regarding your medications and health conditions.

3. Usage Rules

You agree to use Phill solely for its intended personal, non-commercial purpose and in compliance with all applicable laws and regulations. You agree that you will NOT:

Use the App for any commercial purpose or on behalf of any third party without our prior written consent
Attempt to reverse-engineer, decompile, disassemble, modify, or create derivative works of the App or any portion thereof
Use the App to input, store, or transmit any content that is unlawful, harmful, defamatory, abusive, threatening, or otherwise objectionable
Attempt to circumvent, disable, or interfere with any security features, license enforcement mechanisms, or access controls of the App
Use automated scripts, bots, or other automated means to access or interact with the App
Use the App in any manner that could damage, disable, overburden, or impair the App or the systems supporting it
Reproduce, duplicate, copy, sell, or exploit any portion of the App without express written permission from MintSoft
Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices within the App
Violate any applicable local, national, or international law or regulation in connection with your use of the App

We reserve the right to investigate and take appropriate action for any violation of these rules, including suspending or terminating your access to the App.

4. Intellectual Property

The App, including its source code, design, graphics, user interface, features, content, trademarks, service marks, and all other materials, is owned by MintSoft or its licensors and is protected by the copyright, trademark, and intellectual property laws of the Republic of Korea and applicable international treaties and conventions.

Subject to your compliance with these Terms, MintSoft grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a personal device that you own or control, solely for your personal, non-commercial use. This license does not include the right to: (a) sell, resell, or commercially exploit the App; (b) copy or distribute the App except as expressly permitted; or (c) use any data mining, scraping, or similar data-gathering methods on the App.

You retain full ownership of all personal data you enter into the App, including medication records, photos, and notes. MintSoft claims no ownership rights over this content. Because your data is stored locally on your device and not transmitted to our servers, it remains under your control at all times.

Nothing in these Terms transfers any intellectual property rights to you, and all rights not expressly granted are reserved by MintSoft.

5. In-App Purchases and Subscriptions

Phill may offer optional premium features, subscription plans, or one-time purchases ("Purchases") that unlock additional functionality beyond the free tier. All Purchases are processed through the Apple App Store or Google Play Store and subscription entitlements are managed via RevenueCat.

Pricing and Billing

Prices for Purchases are displayed in the App at the time of purchase and may vary by region and currency. All prices are inclusive of applicable taxes where required by law. You will be charged to your App Store or Google Play account upon confirming a purchase.

Subscriptions

Subscription plans automatically renew at the end of each billing period (monthly or annually, as selected) unless you cancel at least 24 hours before the renewal date. Renewal charges will be applied to your App Store or Google Play account. You can manage or cancel your subscription at any time through your device's App Store or Google Play account settings.

Refunds

All refund requests are handled exclusively by Apple or Google according to their respective refund policies. MintSoft does not directly process refunds. If you believe you are entitled to a refund, please contact Apple Support or Google Play Support.

Free Trials

If a free trial is offered for a subscription, you will not be charged until the trial period ends. To avoid being charged, you must cancel the subscription before the trial period expires. Upon cancellation, access to premium features will continue until the end of the free trial period.

Price Changes

MintSoft reserves the right to modify subscription pricing at any time. For existing subscribers, we will provide advance notice of price changes through the App or via App Store/Google Play notifications. Your continued subscription after a price change takes effect constitutes your acceptance of the new price.

6. Disclaimers

Health Disclaimer: Phill is a reminder and organizational tool only. It does not constitute medical advice, clinical guidance, or a substitute for professional healthcare services. MintSoft makes no representations about the suitability of the App for any medical purpose. The App does not verify drug interactions, contraindications, or the accuracy of dosage information you enter. Missed medication reminders may occur due to device settings, battery optimization, operating system restrictions, or other technical factors outside our control. Never rely solely on the App to manage a critical medical regimen. Always maintain communication with your healthcare provider.

Service Disclaimer: The App and all content, features, and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. MintSoft does not warrant that: (a) the App will meet your specific requirements; (b) the App will be uninterrupted, timely, secure, or error-free; (c) any notifications will be delivered reliably in all circumstances; or (d) any errors or defects in the App will be corrected. Your use of the App is entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, MintSoft, its founders, officers, employees, contractors, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind arising out of or related to your use of, or inability to use, the App. This includes, without limitation, damages for missed medication doses, adverse health outcomes, loss of data, loss of revenue or profits, business interruption, or any other pecuniary or non-pecuniary loss, even if MintSoft has been advised of the possibility of such damages.

In no event shall MintSoft's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App exceed the greater of: (a) the total amount you paid to MintSoft (directly or through App Stores) in the twelve (12) months preceding the claim giving rise to liability; or (b) USD $10 (ten United States dollars).

Certain jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so some or all of the above limitations may not apply to you. In such jurisdictions, MintSoft's liability shall be limited to the maximum extent permitted by applicable law.

8. Termination

These Terms remain in full force and effect for as long as you use the App. You may terminate these Terms at any time by deleting the App from your device(s) and ceasing all use of the Service.

MintSoft reserves the right, at its sole discretion and without prior notice or liability, to suspend or permanently terminate your access to the App if: (a) you breach any provision of these Terms; (b) we are required to do so by law or a competent authority; (c) we decide to discontinue the App or any portion of it; or (d) continued provision of the App to you is no longer commercially viable.

Upon termination for any reason: (a) the license granted to you under these Terms shall immediately cease; (b) you must delete the App from all your devices; (c) locally stored App data will remain on your device until you delete it manually. Active paid subscriptions will continue until the end of the current billing period unless terminated by the applicable app store platform.

The following sections shall survive termination of these Terms: Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and any other provisions that by their nature should survive.

9. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed exclusively in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles or provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms, including questions regarding their existence, validity, breach, or termination, shall be submitted to the exclusive jurisdiction of the competent courts located in Seoul, Republic of Korea.

If you are a consumer resident in a jurisdiction whose laws require disputes to be resolved in local courts or under local law, these governing law provisions shall apply only to the maximum extent permitted by your applicable local law. Nothing in this section shall be interpreted to limit any non-waivable consumer rights you may have under the laws of your country of residence.

Before initiating any formal legal proceeding, we encourage you to contact us at app@mint-soft.com to attempt to resolve any dispute informally. We will make reasonable efforts to resolve concerns amicably within 30 days of receiving your written notice.
