Acceptance of Terms

By downloading, installing, or using Alarmy - Disaster Alerts ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not install or use the App. These Terms form a legally binding agreement between you ("User") and MintSoft ("we," "us," or "our"), a software developer based in the Republic of Korea. We reserve the right to modify these Terms at any time. We will notify you of material changes via an in-app notice or by updating the effective date above. Your continued use of the App after any modification constitutes your acceptance of the updated Terms.

Service Description

Alarmy - Disaster Alerts is a mobile application that aggregates and presents real-time disaster information, public safety alerts, and emergency event data to help users stay informed. Core features include a live disaster feed, regional alert filtering and bookmarking, an on-device AI assistant powered by Google's Gemma model (running entirely on your device without transmitting data externally), push notification alerts for selected regions, a home screen widget for at-a-glance status, and background data synchronization.

The App is provided on an "as is" and "as available" basis. Disaster alert content is sourced from third-party public data providers and government systems; we do not author or verify the accuracy of such alerts. The App is intended as a supplementary information tool only and must not be treated as an official emergency management system. Always follow directives from local authorities and official government emergency services.

Usage Rules

You agree to use Alarmy only for lawful, personal, non-commercial purposes and in compliance with all applicable laws. You must not:

  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App or its on-device AI model
  • Use automated scripts, bots, scrapers, or other tools to extract data displayed within the App
  • Interfere with or disrupt the App's functionality, servers, or connected third-party services
  • Circumvent, disable, or otherwise interfere with any security features or access controls in the App
  • Use the App's AI chat feature to generate, store, or disseminate harmful, illegal, defamatory, or deceptive content
  • Misrepresent disaster events or use information from the App to spread false emergency alerts
  • Sublicense, sell, resell, transfer, or commercially exploit the App or any portion thereof without our express written consent
  • Use the App in any way that could damage, overburden, or impair its infrastructure or third-party integrations

Violation of these rules may result in immediate suspension or termination of your access to the App without prior notice.

Intellectual Property

All content, features, design elements, graphics, logos, trademarks, and source code comprising Alarmy - Disaster Alerts are the exclusive intellectual property of MintSoft and are protected under the copyright, trademark, and trade secret laws of the Republic of Korea and applicable international intellectual property conventions. The "Alarmy" name, logo, and associated branding are trademarks of MintSoft. Nothing in these Terms grants you any license or right to use MintSoft's trademarks, logos, or proprietary materials without our express prior written consent.

Disaster alert data and public safety information displayed within the App may originate from government agencies, public databases, or licensed third-party data providers; ownership of such content remains with the respective originating entities. The Gemma on-device AI model is a product of Google LLC and is used under Google's applicable model license terms. Your use of the App does not transfer any ownership rights in any of these materials to you.

In-App Purchases and Advertising

Alarmy is free to download and use. The App displays advertisements delivered by Google AdMob. On iOS devices, we request your consent via the App Tracking Transparency (ATT) framework before serving personalized advertisements. You may withdraw this consent at any time through your iOS device Settings > Privacy & Security > Tracking, or adjust ad personalization on Android via Google Settings > Ads.

The App may offer optional in-app purchases (such as an ad-free experience or premium features) processed exclusively through Apple App Store or Google Play billing systems. MintSoft does not directly collect or store your payment information. All purchases are subject to the payment terms and refund policies of the applicable platform store. Except as required by applicable consumer protection law or platform store policy, all in-app purchases are final and non-refundable. If you believe you are entitled to a refund, please contact Apple or Google directly through their respective support channels.

CRITICAL NOTICE: Alarmy - Disaster Alerts is an informational tool only. It is NOT an official emergency alert system. Do NOT rely solely on this App during an active disaster or emergency. Always follow guidance from official government authorities, national emergency management agencies, and local emergency services.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. MINTSOFT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DISASTER INFORMATION, TIMELINESS OF ALERTS, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS. ALERT DATA MAY BE DELAYED, INCOMPLETE, OR INACCURATE DUE TO FACTORS ENTIRELY BEYOND OUR CONTROL, INCLUDING THIRD-PARTY DATA SOURCE FAILURES AND NETWORK OUTAGES.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINTSOFT, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOST PROFITS, LOSS OF GOODWILL, OR SERVICE INTERRUPTION, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You expressly acknowledge that because Alarmy provides disaster and emergency information, reliance on any single information source — including this App — during an emergency carries inherent risk. You assume full responsibility for cross-referencing App content with official emergency communications. To the extent MintSoft's liability cannot be fully excluded under applicable law, our total aggregate liability to you for all claims arising from your use of the App shall not exceed the greater of (a) the total amount you paid to MintSoft in the twelve (12) months preceding the claim, or (b) USD $10.

Termination

These Terms remain in effect for as long as you use the App. We reserve the right to suspend or permanently terminate your access to Alarmy at any time, with or without cause and with or without notice, including where we reasonably believe you have violated these Terms, applicable law, or the rights of any third party. Upon termination, your right to use the App ceases immediately. You may terminate these Terms at any time by uninstalling the App from all of your devices and ceasing all use thereof.

Sections of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and governing law — shall survive any termination or expiration of these Terms. MintSoft also reserves the right to discontinue, modify, or sunset the App or any of its features at any time without liability to you.

Governing Law

These Terms of Service and any disputes arising out of or relating to them or your use of the App shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the competent courts located in the Republic of Korea for the resolution of any such disputes. Notwithstanding the foregoing, if you are a consumer residing in a jurisdiction whose laws provide mandatory consumer protections that cannot be contractually waived (including EU member states and certain US states), those protections shall apply to you in addition to the terms set forth herein.
