Terms of Service

Acceptance of Terms

By downloading, installing, or using MoodLog - Heart Notes ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MintSoft ("we," "us," or "our"), a software developer based in South Korea. If you do not agree to these Terms, do not use the App. Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. These Terms apply to all versions of the App on iOS and Android platforms.

The Service

MoodLog - Heart Notes is a personal emotional wellness application that allows you to log daily moods and diary entries, visualize emotional patterns through statistics and heatmaps, sync mood events with your device calendar, generate AI-powered insights using an on-device language model (Pro feature), and export your data as CSV files. The App is available as a free tier supported by advertising and as a Pro subscription that removes ads and unlocks advanced features including AI Insights and enhanced statistics. We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where possible.

Usage Rules

You agree to use the App only for lawful, personal, non-commercial purposes. You must not:

  • Use the App to store or distribute content that is illegal, harmful, threatening, abusive, defamatory, or violates the rights of others
  • Attempt to reverse engineer, decompile, disassemble, or extract the source code of the App
  • Circumvent, disable, or interfere with security features, including the biometric lock or encrypted storage systems
  • Use automated tools, bots, or scripts to interact with the App
  • Attempt to gain unauthorized access to any systems or services connected to the App
  • Resell, sublicense, or commercially exploit the App or its features
  • Misuse the in-app review or support systems with false or misleading information

You are solely responsible for all content you enter into the App including mood logs and diary notes. While this content is stored locally on your device and never transmitted to us, you remain responsible for maintaining appropriate backups.

Intellectual Property

All rights, title, and interest in and to the App — including but not limited to the software code, design, graphics, user interface, trademarks, logos, and the "MoodLog - Heart Notes" name — are owned by MintSoft or its licensors and are protected by copyright, trademark, and other intellectual property laws of South Korea and applicable international treaties. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for personal use in accordance with these Terms. No rights are granted beyond this express license. The Gemma AI model used for on-device inference is subject to Google's model license terms and is used in compliance with those terms.

Purchases and Subscriptions

The App offers optional in-app purchases including a Pro subscription ("Pro"). All purchases are processed by Apple App Store or Google Play ("Platform") and are subject to the respective Platform's payment terms and refund policies. Key terms:

  • Pricing — subscription prices are displayed in the App prior to purchase and may vary by region
  • Auto-Renewal — Pro subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
  • Cancellation — manage or cancel your subscription through your Apple ID or Google Account subscription settings; cancellation takes effect at the end of the current billing period
  • Refunds — refund requests are handled by Apple or Google in accordance with their policies; MintSoft does not process refunds directly
  • Free Trial — if a free trial is offered, unused portions are forfeited upon purchasing a subscription
  • Price Changes — we reserve the right to change subscription prices; existing subscribers will be notified in advance of any price increase

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. The App is a personal journaling and mood-tracking tool and is not a medical device, mental health treatment, or substitute for professional psychological or psychiatric care. AI Insights generated by the on-device Gemma model are for informational and reflective purposes only and do not constitute medical advice. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or emergency services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINTSOFT AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF MOOD ENTRIES OR DIARY NOTES, LOSS OF REVENUE, OR EMOTIONAL DISTRESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE YOUR DIARY DATA IS STORED ONLY ON YOUR DEVICE, WE ARE NOT RESPONSIBLE FOR DATA LOSS DUE TO DEVICE FAILURE, THEFT, OR UNINSTALLATION. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP OR PRO SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10 IF YOU HAVE NOT MADE ANY PAYMENTS. Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

Termination

These Terms remain in effect as long as you use the App. You may terminate these Terms at any time by deleting the App from your devices. We reserve the right to suspend or terminate your access to the App, including Pro features, at our sole discretion if you violate these Terms, engage in fraudulent activity, or if we discontinue the App. Upon termination, your license to use the App ends immediately. Because your diary data is stored locally on your device, it will remain on your device until you delete it manually or uninstall the App — we have no ability to delete your local data remotely. Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law survive termination.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Korea, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts located in South Korea. If you are a consumer resident in a jurisdiction that provides mandatory consumer protection rights, nothing in these Terms limits those rights. Users in the European Union retain rights under EU consumer protection law.
